Return and Refund

1) Scope of application

• Distance sales: subject to the provisions of the French Consumer Code relating to the right of withdrawal (see §2), except for legal exceptions.
• In-store/on-site sales: no legal right of withdrawal. Commercial solutions may be considered on a case-by-case basis, at the discretion of AUTOMOBILES DE FRANCE.

2) Right of withdrawal (distance sales)

For any sale concluded remotely with a consumer, you have a period of 14 days from receipt of the vehicle (or conclusion of the contract for associated services) to exercise your right of withdrawal, without having to provide a reason.

Conditions and Exceptions

• The vehicle must be returned in the same condition as when it was delivered, with all documents, keys, accessories and options.
• You may handle and test drive the vehicle as you would at a dealership. Any use beyond what is necessary to establish the nature, characteristics, and proper functioning of the vehicle may result in imputable depreciation.
• The right of withdrawal does not apply to vehicles customized to customer specifications (custom configurations, special options) or clearly personalized vehicles.

3) Return Procedure

1. Notification: Exercise your right within 14 days (§2).
2. Arrange an appointment: We will agree on a return date and location (our premises or an authorized carrier). The return costs are your responsibility, unless there is a lack of conformity.
3. Return: the vehicle is returned cleaned, with all keys/documents (registration document, COC, logbook, manuals), and with a full tank of fuel as upon delivery, if applicable.
4. Inspection: a joint inventory is carried out. Defects (impacts, scratches, abnormal wear, clearly excessive mileage, missing maintenance) may result in a reconditioning charge or a deduction from the refund.

4) Refund deadlines and terms

• We will refund all payments received for the vehicle within 14 days of the cancellation notification. We may defer the refund until the vehicle is recovered or until you have provided proof of shipment.
• The refund will be made using the same payment method used for the initial transaction, unless expressly agreed otherwise.
• The following may be deducted: depreciation of the vehicle due to excessive handling, reconditioning, and depreciation. condition, missing expenses (keys, documents, accessories), abnormal mileage beyond reasonable trial use.
• The following are not reimbursed: registration/vehicle registration fees, license plate, insurance, fuel, and service options already provided (e.g., special preparation), except in the event of a lack of conformity.

5) Ancillary Products/Services

In the event of withdrawal from the vehicle purchase, ancillary contracts taken out remotely (e.g., extended warranties, non-mandatory ancillary insurance) are cancelled free of charge when they follow the fate of the main contract, in accordance with the French Consumer Code.

6) Lack of Conformity & Warranties

Regardless of the withdrawal, you benefit from the warranties Legal:

• Legal Guarantee of Conformity (L.217-3 et seq. Consumer Code): defects existing on the date of delivery.
• Latent Defects Warranty (1641 et seq. Civil Code): defects rendering the item unfit for use.

In the event of a defect, contact us immediately: contact@automobilesdefrance.com. We will arrange for diagnosis, repair, replacement, or resolution in accordance with the legal framework.

7) Cancellation before delivery

Before delivery, any cancellation request must be made in writing. When the sale was concluded remotely, the right of withdrawal can be exercised from the conclusion of the sale and up to 14 days after delivery. Any costs incurred (transport, preparation, specific services) may remain the responsibility of the customer if they have been expressly accepted and already performed.
